The Better Places network places great value on protecting personal data. This Privacy Statement provides clear and transparent information about how we handle personal data. This Privacy Statement applies to all data collected from individuals who use our services or communicate with the Better Places network. This policy also describes the choices our website visitors and customers have regarding their privacy. We make every effort to ensure privacy and therefore handle personal data with care. If you do not agree with this policy, please do not use our services.

When we refer to “the Better Places network”, “we” or “us” in this statement, we are referring to Better Places International B.V. This includes Better PlacesBetter Places TravelFairaway and Better Tourism Academy. Better Places is a platform that connects travellers with local travel agents. We own and operate a number of websites and offer related services in different countries. In this policy, we refer to all these products, along with our other services and websites, as “Services”.

What are personal data?

A personal data is a given that can be traced to an “identified or identifiable natural person”. This means that the name of a person to whom the data relates to is known, or this person can be traced. Where appropriate, users may be asked to provide personal details such as their name, email address, phone number, physical address, postal code, country, gender, passport details, date of birth, nationality, dietary requirements/allergies and travel and cancellation insurance.

Legislation and regulations regarding privacy

As the Better Places network, we are responsible for processing personal data. The Better Places network is in all cases subject to the laws and regulations, including the General Data Protection Regulation. This implies that we at least:

  • Process personal data in accordance with the purpose for which it was provided. These goals and type of personal data are described in this Privacy Statement;
  • Limit processing your personal data to only those data that are minimally required for the purposes for which they were provided;
  • Ask for your explicit consent before processing your personal data;
  • Have taken appropriate technical and organizational measures to ensure security of your personal data;
  • Do not transmit personal data to other parties, unless required for the purposes for which they were provided;
  • Aware of the rights concerning personal data, to inform our users and to respect them.

We collect personal data when provided to us and when our Services are being used. How we use the collected data depends partly on the used Services, how they are used, and on all communicated preferences. Below you can find specific purposes for which we use collected data.

Processing personal data of potential customers

Personal data of potential customers are processed by the Better Places network for the following objective(s):

  • Administrative purposes;
  • Communication about Services;
  • Executing Services;
  • For research and development.

The basis for personal data is:

  • Agreeing on the provision of a Service

For above objective(s), the Better Places network can request the following personal data:

  • First name;

  • Phone number;

The Better Places network stores personal data for the abovementioned processing(s) for the period:

  • During the term of communication and afterwards for statistical purposes for a maximum of 10 years (after the last communication).
Processing personal data of customers

Personal data of customers are processed by the Better Places network for the following objective(s):

  • Administrative purposes;
  • Communication about Services;
  • Monitoring the communication about Services;
  • Executing Services;
  • The inventory of satisfaction with the Services performed by the Better Places network;
  • Requesting reviews;
  • For research and development.

The basis for personal data is:

  • The agreed booking order (Services);

 For above objective(s), the Better Places network can request the following personal data:

  • First name;
  • Surname prefix;
  • Surname;
  • Phone number;
  • Address;
  • Postal code;
  • Email address;
  • Sex;
  • Date of birth;
  • Passport data;
  • Nationality;
  • Dietary requirements/allergies;
  • Travel and cancellation insurances.

The Better Places network stores personal data for the abovementioned processing(s) for the period:

  • during the term of agreement and in the financial administration for 10 years.
Processing personal data of emergency contacts of customers

Personal data of those staying at home are processed by the Better Places network for the following purpose(s):

  • In case of an emergency.

The basis for personal data is:

  • Interest of the person concerned.

For the purpose(s) above, Better Places can request the following personal data:

  • First name;
  • Surname;
  • Phone number.

The provider of the personal details of the emergency contact is responsible for obtaining permission and informing the emergency contact of the fact that the Better Places network possesses these data.

The Better Places network stores personal data for the abovementioned processing(s) for the period:

  • During the period the customer is travelling;
  • Up to 10 years in the administration;

The retention period for those staying at home is the same as that of the traveling customer because of linked files.

Processing personal data of newsletter subscribers

Personal data from newsletter subscribers are processed by the Better Places network for the following objective(s):

  • Informing the person by means of news statements;
  • Offering offers and promotions;
  • Personalising Services.

In case you receive e-mails from the Better Places Network, the interactions are registered with the aim to adjust the content of our communication with what we think is relevant to you. The basis for personal data is:

  • The newsletter registration form;
  • Opt-in when requesting or booking a service;
  • Online offers (e.g. Facebook).

For above objective(s), the Better Places network can request the following personal data:

  • First name;
  • Surname;
  • Email address.

The Better Places network stores personal data for the abovementioned processing(s) for the period:

  • During the period a person is registered;
  • Newsletter subscribers always have the possibility to modify/delete their registration by the indicated links in every mailing.

Newsletter subscribers registered before May 25 (2018) have not been approached for explicit permission due to the fact that:

  • We have never bought email addresses;
  • We have never added a subscriber to the mailing list without cause;
  • We are in possession of consent of a large proportion of our subscribers;
  • We give the possibility to unsubscribe in every mailing;
  • We regularly clean up our mailing list.
Processing personal data of prospects, stakeholders and/or interested parties

Personal details of prospects, stakeholder/lobby contacts and/or interested parties are processed by the Better Places network for the following objective(s):

  • Providing information about possible cooperation in the form of targeted contact emails.

The basis for personal data is:

  • Oral permission (e.g. on an exhibition), issuing of a business card and/or LinkedIn or email.

For above objective(s), the Better Places network can request the following personal data:

  • First name;
  • Insertion;
  • Surname;
  • Phone number;
  • Email address;
  • Address details;

The Better Places network stores personal data for the abovementioned processing(s) for the period:

  • During the period that one is seen as a prospect, stakeholder and/or interested party, with a maximum of 10 years (after the last contact).

Personal data of children under 16

When a travel request or booking is made by a minor (<16), we will always request written permission from the parent/caretaker for processing their personal data. When minor fellow travellers are included in a booking, we will do our best to confirm the main booker is the parent/caretaker of the minor, and that they give permission to process personal details of the minor.

Disclosure to third parties

Personal data provided to the Better Places network can be provided to third parties if needed for the execution of the above described purposes. We use third parties for:

  • The execution of an assignment/contract – DMC’s (Destination Management Organisations: a.k.a. local experts) (NOTE: outside EU), Travefy;
  • Taking care of (financial) administration – Rickshaw Travel.

The following third parties are necessary for carrying out above-described purposes, but basically, they do not have direct access to personal data. However, we do use their services for processing personal data.

  • Providing newsletters and surveys – MailChimp, Survey Monkey;
  • Requesting ratings and reviews – Trustpilot;
  • Marketing purposes – Facebook, Google AdWords;
  • Providing ICT infrastructure – Oxilion, SiteSpirit;
  • Analysing website visitors for website optimisation (not traceable to individuals) – Hotjar, Google Analytics.

We have made clear contractual agreements (processing agreements) with these third parties to guarantee the security of personal data. Some of these third parties we have processing agreements with, are located in countries that may not have equivalent privacy and data protection legislation as in the Netherlands. The Better Places network is exempted from the general prohibition on transferring personal data outside the EU, due to the fact data transfer is necessary for the execution of a contract between the customer and the organisation, as well as for pre-contractual steps taken at the request of the customer.

We never disclose personal data to other parties with whom we have not entered into a processor agreement. We will not provide the personal data provided to other parties unless this is legally required and/or permitted. We may also share personal data with third parties if we have received written permission for this.

 

Security

We have taken appropriate technical and organizational measures to protect personal data against unlawful processing, such as:

  • All persons able to access your data on behalf of the Better Places network are obliged to maintain their confidentiality;
  • We use a username and password policy on all our systems;
  • We back-up personal data to be able to repair these in case of physical or technical incidents;
  • We regularly test and evaluate our measures;
  • Our employees have been informed about the importance of protecting personal data

 

Rights concerning your personal data

You have the right to inspect, rectify or delete personal data we have received from you. You can also object to processing your personal data (or a part thereof) by us or by one of our processors. Thereby, you also have the right to have information provided by you transferred to yourself, or another party on behalf of you. We can ask you to identify yourself before we can respond to the aforementioned requests. When we are allowed to process your personal data on the basis of a permission given by you, you always have the right to withdraw this permission, provided that this information is no longer required on the grounds of the (e.g. tax) law. In order to view, modify, delete and object to processing your personal data, you can send an email to the Better Places network via below contact details and explicitly specify what data this concerns.

 

Complaints

In case you have a complaint about the processing of your personal data, we ask you to contact us directly. If we cannot solve the issue together, you have the right to file an official complaint at the DPA (Data Protection Authority).
